font-size: x-large;\"><i><strong>is the Record Vote <\/strong><\/i><\/span><\/span><span style=\"font-size: x-large;\"><strong>of where each SC Senator stands on legal Personhood for the preborn ( and therefore protection of their God-given, unalienable right to life under Article I, Section 3, of the <\/strong><a href=\"http:\/\/www.scstatehouse.gov\/scconstitution\/scconst.php\" target=\"_blank\"><strong>South Carolina Constitution<\/strong><strong> ).<br \/>\n<\/strong><\/a><\/span><span style=\"font-size: xx-small;\"><strong><br \/>\n<\/strong><\/span><span style=\"font-size: large;\"><strong>_____________________________<br \/>\n_____________________________<br \/>\n<\/strong><\/span><span style=\"font-size: x-large;\"><br \/>\n<\/span><span style=\"font-size: large;\"><b>SC Personhood Amendment Status Summary:<\/b><\/span><\/p>\n<p><b>1.\u00a0 SC Senate Judiciary Chairman <a href=\"http:\/\/www.scstatehouse.gov\/member.php?code=1172727132\" target=\"_blank\">Larry Martin<\/a> ( R-Pickens ) is refusing to assign <a href=\"http:\/\/www.scstatehouse.gov\/sess121_2015-2016\/bills\/719.htm\" target=\"_blank\">S.719<\/a> to a Judiciary Subcommittee where it could receive a public hearing.\u00a0 <a href=\"http:\/\/www.scstatehouse.gov\/sess121_2015-2016\/bills\/719.htm\" target=\"_blank\">S.719<\/a> was introduced in the SC Senate on April 28, 2015, <u>ten months ago<\/u>.\u00a0Yet despite the fact that Senator Larry Martin has been repeatedly asked to assign <a href=\"http:\/\/www.scstatehouse.gov\/sess121_2015-2016\/bills\/719.htm\" target=\"_blank\">S.719<\/a> to a favorable subcommittee, he refuses to assign it to any Judiciary Subcommittee whatsoever, unless <a href=\"http:\/\/www.scstatehouse.gov\/sess121_2015-2016\/bills\/719.htm\" target=\"_blank\">S.719<\/a> first passes out of the SC House.<br \/>\n[ <u>Note<\/u>:\u00a0 SC House Judiciary Chairman <a href=\"http:\/\/www.scstatehouse.gov\/member.php?code=0463636308\" target=\"_blank\">Greg Delleney<\/a> ( R-Chester and York ) has repeatedly said, publicly and privately, that <span style=\"color: #ff0000;\">IF<\/span> personhood legislation is passed by the SC Senate, he will get it passed in the SC House ( A SC Personhood bill was passed one time by the SC House on <a href=\"http:\/\/christianlifeandliberty.net\/2015-04-28-History-of-Personhood-Legislation-in-South-Carolina-1998-2015.pdf\" target=\"_blank\">April 14, 2005<\/a> ( <a href=\"http:\/\/www.scstatehouse.gov\/sess116_2005-2006\/bills\/3213.htm\" target=\"_blank\">91 &#8211; Y, 10 &#8211; N<\/a> ), albeit with a fatal flaw &#8220;exception&#8221; amendment ) ].<\/b><\/p>\n<p>SC Senator Larry Martin is what is known as a <span style=\"color: #ff0000;\">&#8220;judicial supremacist&#8221;<\/span>, erroneously believing that <span style=\"color: #ff0000;\"><i>OPINIONS<\/i><\/span> of the US Supreme Court are the supreme Law of the Land.\u00a0 They are <u>NOT<\/u>.\u00a0 According to a plain reading of the WRITTEN TEXT of the Article VI Supremacy Clause of the US Constitution [ <a href=\"http:\/\/constitutionus.com\/\" target=\"_blank\">www.constitutionus.com<\/a> ], US Supreme Court <span style=\"color: #ff0000;\"><i>OPINIONS <\/i><\/span>are <u>NOT<\/u> the supreme Law of the Land.\u00a0 [ <u>Note<\/u>: The &#8220;Supremacy Clause&#8221; is actually all of <a href=\"http:\/\/constitutionus.com\/#a6c2\" target=\"_blank\">Clause 2<\/a> of Article VI. ]<\/p>\n<p>The very first sentence of Article I., Section 1. of the <a href=\"http:\/\/constitutionus.com\/\" target=\"_blank\">United States Constitution<\/a> states that &#8220;All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.&#8221;<\/p>\n<p>If <span style=\"color: #0000ff;\"><u>ALL<\/u><\/span> legislative Powers granted by the US Constitution are vested in the US Congress, then that leaves <span style=\"color: #ff0000;\"><u>ZERO<\/u><\/span> legislative Powers granted by the US Constitution vested in the US Supreme Court.\u00a0 It is <u>NOT<\/u> within the constitutional authority of the US Supreme Court to legislate, to make law.\u00a0 The Oath of Office of officeholders is to uphold the <u>WRITTEN TEXT<\/u> of the United States Constitution, <u>NOT<\/u> the <span style=\"color: #ff0000;\"><i>OPINIONS<\/i><\/span> of five members of the US Supreme Court !<\/p>\n<p><span style=\"font-size: xx-small;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>These concepts have been repeatedly upheld by United States Presidents ( Jefferson, Madison, Jackson, Lincoln ), and constitutional scholars, authors, and attorneys:<span style=\"font-size: x-large;\"><br \/>\n<\/span><\/p>\n<p><strong><a href=\"http:\/\/christianlifeandliberty.net\/CONLAW05.DOC\" target=\"_blank\">Presidents Thomas Jefferson and Andrew Jackson:<br \/>\nThe Supreme Court is not the final arbiter of the Constitution<\/a><\/strong><\/p>\n<p><a href=\"http:\/\/christianlifeandliberty.net\/CONLAW05.DOC\" target=\"_blank\">http:\/\/christianlifeandliberty.net\/CONLAW05.DOC<\/a><span style=\"font-size: 300%;\"><br \/>\n<\/span>&#8221; In 1788, James Madison wrote, \u201cThe several departments being perfectly co-ordinate by the terms of their common commission, neither of them, it is evident, can pretend to an exclusive or superior right of settling the boundaries between their respective powers.\u201d &#8221;<br \/>\n<span style=\"font-size: small;\"><a href=\"https:\/\/americanprinciplesproject.org\/founding-principles\/statement-calling-for-constitutional-resistance-to-obergefell-v-hodges%E2%80%AF\/\" target=\"_blank\">https:\/\/americanprinciplesproject.org\/founding-principles\/statement-calling-for-constitutional-resistance-to-obergefell-v-hodges%E2%80%AF\/<\/a><br \/>\n<\/span><\/p>\n<p><span style=\"font-size: small;\"><strong>On March 4, 1861, in his First Inaugural Address, President Abraham Lincoln said:<\/strong><br \/>\n<\/span><span style=\"font-size: xx-small;\"><br \/>\n<\/span>&#8220;I do not forget the position assumed by some that constitutional questions are to be decided by the Supreme Court, nor do I deny that such decisions must be binding in any case upon the parties to a suit as to the object of that suit, while they are also entitled to very high respect and consideration in all parallel cases by all other departments of the Government. And while it is obviously possible that such decision may be erroneous in any given case, still the evil effect following it, being limited to that particular case, with the chance that it may be overruled and never become a precedent for other cases, can better be borne than could the evils of a different practice. At the same time, the candid citizen must confess that if the policy of the Government upon vital questions affecting the whole people is to be irrevocably fixed by decisions of the Supreme Court, the instant they are made in ordinary litigation between parties in personal actions the people will have ceased to be their own rulers, having to that extent practically resigned their Government into the hands of that eminent tribunal.&#8221;<br \/>\n<span style=\"font-size: small;\"><a href=\"http:\/\/www.bartleby.com\/124\/pres31.html\" target=\"_blank\">http:\/\/www.bartleby.com\/124\/pres31.html<\/a><\/span><\/p>\n<p>[ <u>Note<\/u>: Lincoln was referring to the US Supreme Court&#8217;s infamous <a href=\"https:\/\/en.wikipedia.org\/wiki\/Dred_Scott\" target=\"_blank\">Dred Scott<\/a> case ( 1857 ) <span style=\"color: #ff0000;\"><b><i>OPINION,<\/i><\/b><\/span> written by Chief Justice <a href=\"https:\/\/en.wikipedia.org\/wiki\/Roger_B._Taney\" target=\"_blank\">Roger Taney<\/a>, which not only denied the slave Dred Scott freedom and citizenship, but also reached back 37 years to arrogate to itself the authority to declare <span style=\"font-size: small;\">the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Missouri_Compromise\" target=\"_blank\">1820 Missouri Compromise<\/a> passed by the United States Congress, to be unconstitutional.\u00a0 The Missouri Compromise of 1820 &#8221; <\/span>regulated <a href=\"https:\/\/en.wikipedia.org\/wiki\/Slavery_in_the_United_States\" target=\"_blank\">slavery<\/a> in the country&#8217;s <a href=\"https:\/\/en.wikipedia.org\/wiki\/Historic_regions_of_the_United_States\" target=\"_blank\">western territories<\/a> by prohibiting the practice in the former <a href=\"https:\/\/en.wikipedia.org\/wiki\/Louisiana_Territory\" target=\"_blank\">Louisiana Territory<\/a> north of the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Parallel_36%C2%B030%E2%80%B2_north\" target=\"_blank\">parallel 36\u00b030 north<\/a>, except within the boundaries of the proposed state of <a href=\"https:\/\/en.wikipedia.org\/wiki\/Missouri\" target=\"_blank\">Missouri<\/a> .&#8221;\u00a0 [ <a href=\"https:\/\/en.wikipedia.org\/wiki\/Missouri_Compromise\" target=\"_blank\">https:\/\/en.wikipedia.org\/wiki\/Missouri_Compromise <\/a>].\u00a0 Despite the ruling of the US Supreme Court declaring the 1820 Missouri Compromise to be unconstitutional, and declaring the US Congress could not ban Slavery in the western territories, the United States Congress and President Abraham Lincoln did just that.\u00a0 On June 19, 1862, the United States Congress &#8221; <a href=\"https:\/\/cwemancipation.wordpress.com\/2012\/06\/19\/slavery-ends-in-the-territories\/\" target=\"_blank\">ended slavery in the western territories<\/a>.&#8221;\u00a0 The text of this &#8220;law enacting emancipation in the Federal Territories&#8221; is posted <a href=\"http:\/\/www.freedmen.umd.edu\/freeterr.htm\" target=\"_blank\">here<\/a>.<\/p>\n<p><u>The pertinent point here is<\/u>:\u00a0 T<u>he United States Congress and the United States President <b>DEFIED<\/b> the <span style=\"color: #ff0000;\"><b><i>OPINION<\/i><\/b><\/span> of the US Supreme Court<\/u>. ]<br \/>\n<b><a href=\"http:\/\/christianlifeandliberty.net\/HerbTitus0501.doc\" target=\"_blank\">&#8220;Abortion is not legal&#8221; &#8211; Christine Ross and Herbert W. The SC Election Commission <a href=\"http:\/\/www.scvotes.org\/files\/2016%20Election%20Calendar%202016-01-19.pdf\" target=\"_blank\">2016 Election Calendar<\/a> lists the beginning of the filing period for all candidates seeking a political party nomination for the office of SC State Senate and SC State House of Representatives ( and other federal and local offices ) to be March 16, 2016.\u00a0 This filing period closes at 12 noon on March 30, 2016.<br \/>\n<\/b><\/p>\n<p><b>3.\u00a0 The SC Personhood Constitutional Amendment is filed in the SC House ( <a href=\"http:\/\/www.scstatehouse.gov\/sess121_2015-2016\/bills\/4093.htm\" target=\"_blank\">H.4093<\/a> ) and the SC Senate ( <a href=\"http:\/\/www.scstatehouse.gov\/sess121_2015-2016\/bills\/719.htm\" target=\"_blank\">S.719<\/a> ).<\/b><\/p>\n<p>a.\u00a0 <u>SC House of Representatives<\/u> &#8211; <a href=\"http:\/\/www.scstatehouse.gov\/sess121_2015-2016\/bills\/4093.htm\" target=\"_blank\">H.4093<\/a><\/p>\n<p>(1)\u00a0 In the SC House of Representatives, <a href=\"http:\/\/www.scstatehouse.gov\/sess121_2015-2016\/bills\/4093.htm\" target=\"_blank\">H.4093<\/a> has 53 co-sponsors, plus two more Representatives who have signed the <a href=\"https:\/\/personhood.sc\/pledge\/pledge-signers\/\" target=\"_blank\">SC Pastors Alliance Pledge<\/a>, but who have not signed on yet as co-sponsors, for a total of 55 members of the SC House of Representatives who are supporting the SC Personhood Constitutional Amendment.
