to Human Personhood.<br \/>\n<span style=\"font-size: x-large;\"><br \/>\n<\/span><b>The Black&#8217;s Law Dictionary and the Webster&#8217;s Dictionary first definition of a &#8220;Person&#8221;, is &#8220;A Human Being&#8221; !!!<\/b><\/p>\n<p><span style=\"font-size: large;\">__________________________________________<br \/>\n__________________________________________<\/span><\/p>\n<p>Personhood Legislation was first introduced in the South Carolina General Assembly in February 1998 ( <a href=\"http:\/\/www.scstatehouse.gov\/sess112_1997-1998\/bills\/4558.htm\">H.4558<\/a>, <a href=\"http:\/\/www.scstatehouse.gov\/sess112_1997-1998\/bills\/1060.htm\">S.1060<\/a> ), and has been active every year since, including in the current 2017-2018 SC Legislative Session:<br \/>\n<span style=\"font-size: large;\"><br \/>\n<\/span><b>2017-2018 Personhood Bills in the SC State Legislature: <a href=\"http:\/\/www.scstatehouse.gov\/billsearch.php?billnumbers=217\">S.217<\/a>, <a href=\"http:\/\/www.scstatehouse.gov\/billsearch.php?billnumbers=3530\">H.3530<\/a><br \/>\n<\/b><span style=\"font-size: large;\"><br \/>\n<\/span><b><a href=\"http:\/\/christianlifeandliberty.net\/2016-11-12-History-of-Personhood-Legislation-in-South-Carolina-1998-2016.pdf\">History of Personhood Legislation in South Carolina ( 1998 &#8211; 2016 )<\/a><\/b><br \/>\n<span style=\"font-size: small;\"><a href=\"http:\/\/christianlifeandliberty.net\/2016-11-12-History-of-Personhood-Legislation-in-South-Carolina-1998-2016.pdf\">http:\/\/christianlifeandliberty.net\/2016-11-12-History-of-Personhood-Legislation-in-South-Carolina-1998-2016.pdf<\/a><br \/>\n<\/span><span style=\"font-size: large;\"><br \/>\n<\/span><b>So February 2018 will mark 20 years in which Personhood legislation has been active in the SC State Legislature.<br \/>\n<\/b><span style=\"font-size: x-large;\"><br \/>\n<\/span>During the 19 years from 1998 to 2017, a SC Personhood Bill passed the full SC House of Representatives <span style=\"color: #ff0000;\"><b><i>ONE TIME,<\/i><\/b><\/span> on <a href=\"http:\/\/www.scstatehouse.gov\/sess116_2005-2006\/bills\/3213.htm\">April 14, 2005<\/a>, albeit with a fatal flaw so-called &#8220;morning-after-pill&#8221; rape &#8220;exception&#8221; <a href=\"http:\/\/www.scstatehouse.gov\/sess116_2005-2006\/hj05\/20050413.htm\">amendment<\/a> which was unfortunately added on the floor of the SC House of Representatives, after the bill ( <a href=\"http:\/\/www.scstatehouse.gov\/sess116_2005-2006\/bills\/3213.htm\">H<\/a> <a href=\"http:\/\/www.scstatehouse.gov\/sess116_2005-2006\/bills\/3213.htm\">.3213<\/a> &#8211; 52 co-sponsors ) had passed both the Constitutional Laws Subcommittee and the full House Judiciary Committee, without amendment.\u00a0 There can be no &#8220;exceptions&#8221; to recognizing the &#8220;Personhood&#8221; Neither in Texas nor in any other State are all abortions prohibited. Despite broad proscription, an exception always exists.\u00a0 The exception contained <span style=\"color: #0000ff; font-size: small;\">[410 U.S. 113, 158]<\/span><span style=\"color: #005500; font-size: small;\">\u00a0 <\/span><a name=\"158\"><\/a>in Art. 1196, for an abortion procured or attempted by medical advice for the purpose of saving the life of the mother, is typical. <span style=\"color: #ff0000;\">But if the fetus is a person who is not to be deprived of life without due process of law, and if the mother&#8217;s condition is the sole determinant, does not the Texas exception appear to be out of line with the Amendment&#8217;s command?&#8221;\u00a0 <\/span><\/i><\/b>[ emphasis added ]<br \/>\n<span style=\"color: #ff0000; font-size: x-large;\"><b><br \/>\n<\/b><\/span>There are other inconsistencies between Fourteenth Amendment status and the typical abortion statute. It has already been pointed out, n. 49, supra, that in Texas the woman is not a principal or an accomplice <span style=\"color: #ff0000;\"><b>with respect to an abortion\u00a0<\/b><\/span>upon her.<b> <span style=\"color: #ff0000;\">If the fetus is a person, why is the woman not a principal or an accomplice?<\/span><\/b> Further, the penalty for criminal abortion specified by Art. 1195 is significantly less than the maximum penalty for murder prescribed by Art. 1257 of the Texas Penal Code.
