SC House Ad Hoc Committee Fails to Establish Justice in Recommended Language for “Abortion” Legislation; Adopted July 19, 2022<\/b><\/span><\/p>\n SC House Ad Hoc Committee Amendment to H5399<\/a><\/strong> On July 19, 2022, by vote of 9 [ 8R, 1D ] to 3 [ 3D ], the Ad Hoc Committee on “abortion” legislation proposed language for H5399<\/a> which, the unenforceable words of the Legislative “Findings” notwithstanding, does not<\/u><\/span><\/strong> statutorily recognize the Unborn as Persons,<\/span> and therefore, in actuality, denies<\/u><\/span><\/strong>\u00a0Equal Protection<\/span> for ALL<\/u><\/span>\u00a0Unborn Children. – Bans nearly all “abortions” committed by surgical and RU486 means, including for children conceived in cases of rape and incest, and those who are handicapped ( so-called “fetal anomalies” [sic]<\/i> ).<\/strong><\/p>\n – Does not<\/u><\/span> entirely<\/u><\/b><\/span>\u00a0ban intentionally killing<\/u><\/span> the baby for the morally and ethically unacceptable<\/u><\/span>,<\/u><\/b><\/span> as well as false,<\/u><\/b><\/span> medically unnecessary<\/u><\/span> excuses of saving the life, or preventing “substantial and irreversible physical impairment” of the mother. This is similar to the unbiblical<\/a>, unjust position of National Right to Life<\/a> and their SC Chapter, SC Citizens for Life. In this context of the life\/serious health of the mother, the proposed language<\/a> for H5399<\/a><\/b> does<\/u><\/b> state, “… when an unborn child is alive in utero, the physician must make all reasonable efforts to deliver and save the life of an unborn child during the process of separating the unborn child from the pregnant woman”; however it continues, “to the extent it does not adversely affect the life or health of the pregnant woman, and in a manner consistent with reasonable medical practice” [Section 44-41-830(C)<\/a>]. This latter wording leaves open the possibility and availability of\u00a0 intentionally killing<\/u><\/span> the baby by “abortion”, and in fact the proposed language<\/a> for H5399<\/a><\/b> actually uses the term “<\/b><\/span>permitted abortion<\/u><\/b><\/span>” <\/b><\/span>in Section 44-41-830(B)<\/a>. However<\/u><\/b>,<\/em> it is not<\/u><\/span>\u00a0medically necessary<\/u><\/span> to intentionally kill<\/u><\/span>\u00a0the unborn child to save the life of the mother [See DublinDeclaration.<\/a>com<\/a>, with over 1,000 medical field signatories; and as posted here<\/a>. Everett Koop, pediatric surgeon, former United States Surgeon General (1982-1989) as posted here<\/a>.].<\/strong><\/p>\n – Criminalizes the abortionist; and, after due process, also provides for revocation of the abortionist’s physician’s license by the State Board of Medical Examiners for South Carolina.<\/strong><\/p>\n – Does not<\/u><\/span> criminalize the mother soliciting the “abortion”. This is consistent with the unbiblical<\/a>, unjust position of National Right to Life<\/a> and their SC Chapter, SC Citizens for Life<\/a>.<\/strong><\/p>\n This is contrary to the pre-1970 “abortion” law in South Carolina (Section 16-84<\/a>), which provided up to two years in jail or a $1,000 fine to the woman soliciting an “abortion”.<\/strong><\/p>\n – Does not<\/u><\/span> ban chemical “abortions”<\/a> by abortifacient<\/u><\/span><\/em> “<\/span>birth<\/a> control<\/a>“<\/span>.<\/b><\/strong><\/p>\n – Does not ban in vitro fertilization (IVF). \n<\/span>The Ad Hoc Committee has essentially served as a drafting committee to propose language for H5399<\/a>. Their recommendation adopted July 19 now goes to the SC House Judiciary Committee for the bill process to continue.

\n<\/span>The proposed language<\/a> for H5399<\/a><\/strong> adopted July 19 by the Ad Hoc Committee:<\/b><\/p>\n
\n“Notwithstanding the above, the practice of\u00a0 <\/span><\/span><\/b><\/strong>“selective reduction,” (defined as a procedure to stop the development of one or more fetuses in utero<\/em>) shall constitute an abortion in violation of Section 4, above,<\/span> except, when necessary, in reasonable medical judgment, to prevent a substantial risk of death for another fetus, or the substantial and irreversible physical impairment of a major bodily function of another fetus.”\u00a0<\/span><\/span><\/b><\/strong> [ highlighting emphasis added ]<\/span><\/span><\/p>\n
