[COLUMBIA, SC] The \u201cHuman Personhood at Conception Act\u201d has been introduced in the South Carolina House of Representatives. \u00a0At the present time, this House Bill ( H.5114<\/a><\/span><\/strong> ), introduced on February 5 by Representative Luke Rankin, has five Republican co-sponsors in the 124-seat<\/a><\/strong><\/span> SC House, which presently has 88 Republicans<\/a><\/strong><\/span> and 36 Democrats<\/a>.<\/strong><\/span>\u00a0 Principled pro-life, pro-personhood South Carolinians are asked to visit scstatehouse.gov<\/a><\/u>,<\/strong><\/span> contact and ask their SC Representative, especially Republicans<\/u><\/em>,<\/strong> to sign on as\u00a0co-sponsors of H.5114<\/a><\/strong><\/span> right away. The official SC Republican Party Platform<\/a><\/strong><\/span> asserts \u201cunborn children \u2026 should be classified as legal persons\u201d within The Right to Life plank (p.6).<\/p>\n

Principled Personhood legislation was first introduced in the SC Legislature in 1998<\/a>,<\/strong> <\/span>and had been active every year through 2022<\/a><\/strong><\/span> [ History of Personhood Legislation in South Carolina (1998-2022)<\/a><\/strong><\/span>\u00a0].\u00a0 In 2005, a Personhood Act ( H.3213<\/a><\/strong><\/span> ) passed the SC House, albeit with a fatal flaw \u201cexception\u201d amendment, before being killed in the SC Senate. In 2016, a Personhood Constitutional Amendment ( S.719<\/a><\/strong><\/span> ) passed a Senate Judiciary Subcommittee in March, and passed the full Senate Judiciary Committee in April, before being defeated on the full Senate floor in a vote for Special Order on May 11, 2016 ( 24 Senators<\/a><\/strong><\/span> voted Yes for Special Order, 16 Senators<\/a><\/strong><\/span> voted No, and 2 Senators<\/a><\/strong><\/span> voted Present, however a 2\/3 super-majority was required by SC Senate Rules, and so even though a majority of Senators voted Yes, the motion failed. ).\u00a0 In 2017-2018,\u00a0a Personhood Act ( S.217<\/a><\/strong><\/span> ) passed a Senate Judiciary Subcommittee in April 2017<\/a>,<\/strong><\/span> and\u00a0passed the full Senate Judiciary Committee in February 2018<\/a>,<\/strong><\/span> and the Bill was placed on the SC Senate Calendar; the Senate adopted the Committee Amendment May 1, 2018<\/a>,<\/strong><\/span> and then no further progress.<\/p>\n

The \u201cHuman Personhood at Conception Act\u201d effectively recognizes the Creator God-given, inherent, unalienable right to life of every human being as a legal \u201cperson\u201d beginning at fertilization, in the South Carolina Code of Laws<\/a>,<\/strong> Title 16 – CRIMES AND OFFENSES<\/a>,<\/strong> CHAPTER 3 – OFFENSES AGAINST THE PERSON<\/a>,<\/strong><\/span> ARTICLE 1 \u2013 Homicide.\u00a0 SC House Bill H.5114<\/a><\/strong><\/span> states:<\/strong><\/p>\n

Be it enacted by the General Assembly of the State of South Carolina:<\/strong><\/p>\n

SECTION 1. \u00a0This act may be cited as the \u201cHuman Personhood at Conception Act\u201d. <\/strong><\/p>\n

SECTION 2. \u00a0Article 1, Chapter 3, Title 16 of the S.C. Code is amended by adding: \u00a0<\/strong><\/p>\n

\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 (A) As used in this article, “person” or “persons” means every human being beginning at conception.<\/strong><\/p>\n

\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 (B) As used in this article, “fertilization” means the fecundation of the ovum by the spermatozoon.<\/strong><\/p>\n

\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 (C) As used in this article, “conception” means fertilization.<\/strong><\/p>\n

SECTION 3. \u00a0Chapter 41, Title 44 of the S.C. Code is repealed.<\/strong><\/p>\n
