The term does not include a procedure or act to terminate the pregnancy of a woman with an ectopic pregnancy, nor does it include the procedure or act to terminate the pregnancy of a woman when the unborn child has a <span style=\"color: #ff0000;\"><b>lethal anomaly.<\/b><\/span><\/p>\n<p><span style=\"font-size: small;\">continued&#8230;<\/span><\/p>\n<p>Section 4. (a) It shall be unlawful for any person to intentionally perform or attempt to perform an abortion <span style=\"color: #ff0000;\"><b>except<\/b><\/span> as provided for by subsection (b).<\/p>\n<p>(b) <span style=\"color: #ff0000;\"><b>An abortion shall be permitted<\/b><\/span> if an attending physician licensed in Alabama determines that an abortion is necessary <span style=\"font-size: small;\"><b><i>[ sic ] <\/i><\/b><\/span>in order to prevent a serious health risk to the unborn child&#8217;s mother. &#8230;<\/p>\n<p><span style=\"font-size: small;\">continued&#8230;<\/span><\/p>\n<p>Section 5. <span style=\"color: #ff0000;\"><b>No woman upon whom an abortion is performed or attempted to be performed shall be criminally or civilly liable.<\/b><\/span> Furthermore, no physician confirming the serious health risk to the child&#8217;s mother shall be criminally or civilly liable for those actions.<\/p>\n<p>Section 6. Neither in Texas nor in any other State are all abortions prohibited. Despite broad proscription, an exception always exists. The exception contained <span style=\"color: #005500; font-size: small;\">[410 U.S. 113, 158]\u00a0\u00a0 <\/span><a name=\"158\"><\/a>in Art. 1196, for an abortion procured or attempted by medical advice for the purpose of saving the life of the mother, is typical. But if the fetus is a person who is not to be deprived of life without due process of law, and if the mother&#8217;s condition is the sole determinant, does not the Texas exception appear to be out of line with the Amendment&#8217;s command?<\/p>\n<p>There are other inconsistencies between Fourteenth Amendment status and the typical abortion statute. It has already been pointed out, n. 49, supra, that in Texas the woman is not a principal or an accomplice with respect to an abortion upon her. If the fetus is a person, why is the woman not a principal or an accomplice? Further, the penalty for criminal abortion specified by Art. 1195 is significantly less than the maximum penalty for murder<br \/>\nprescribed by Art. 1257 of the Texas Penal Code.
