\n<\/span>Alabama HB314<\/a> is a near total “abortion” ban bill – the strongest bill banning almost all “abortions” in the United States.\u00a0 However, the bill has “exceptions” and so is not<\/u> a true, principled Personhood bill.\u00a0 HB314<\/a> does not<\/u> establish legal personhood at fertilization ( conception ) with no “exceptions” for all human beings.\u00a0 Furthermore, HB314<\/a> is also flawed because it never holds the mother accountable as either a principal or accessory in those circumstances where such is warranted.
\n<\/span>
\n<\/span>HB314<\/a> <\/b>is stronger than the recent ‘Heartbeat’ bills, and bans nearly all surgical and RU486 “abortions” (child-murders) committed upon women who are known to be pregnant<\/u>, including banning rape and incest “abortions”.\u00a0 However HB314 <\/b><\/a>does not<\/u> ban early abortifacient chemical “abortions”, and has certain “exceptions”.
\n
\n<\/span>Specifically, HB314<\/b><\/a> still allows killing the baby in the case of “lethal anomaly” and “serious health risk” to the mother.
\nHB314<\/a><\/b> also never holds the woman accountable as a principal or even as an accessory in those circumstances where such is warranted.<\/p>\n

(1) ABORTION. The use or prescription of any instrument, medicine, drug, or any other substance or device with the intent to terminate the pregnancy of a woman known to be pregnant<\/b><\/span> with knowledge that the termination by those means will with reasonable likelihood cause the death
\nof the unborn child. The term does not include these activities if done with the intent to save the life or preserve the health of an unborn child, remove a dead unborn child, to deliver the unborn child prematurely to avoid a serious health risk to the unborn child’s mother, or to preserve the health of her unborn child. The term does not include a procedure or act to terminate the pregnancy of a woman with an ectopic pregnancy, nor does it include the procedure or act to terminate the pregnancy of a woman when the unborn child has a lethal anomaly.<\/b><\/span><\/p>\n

Section 4. (a) It shall be unlawful for any person to intentionally perform or attempt to perform an abortion except<\/b><\/span> as provided for by subsection (b).<\/p>\n

(b) An abortion shall be permitted<\/b><\/span> if an attending physician licensed in Alabama determines that an abortion is necessary [ sic ] <\/i><\/b><\/span>in order to prevent a serious health risk to the unborn child’s mother. …<\/p>\n

Section 5. No woman upon whom an abortion is performed or attempted to be performed shall be criminally or civilly liable.<\/b><\/span> Furthermore, no physician confirming the serious health risk to the child’s mother shall be criminally or civilly liable for those actions.<\/p>\n

Section 6. (a) An abortion performed in violation of this act is a Class A felony.<\/p>\n

(b) An attempted abortion performed in violation of this act is a Class C felony.<\/p>\n

Section 8. The construction of existing statutes and regulations that regulate or recognize abortion in Alabama that are in conflict with or antagonistic to this act shall be repealed as null and void and shall recognize the prohibition of abortion as provided in this act. If this act is challenged and enjoined pending a final judicial decision, the existing statutes and regulations that regulate or recognize abortion shall remain in effect during that time.<\/p>\n

\n<\/span>Although HB314<\/b><\/a> defines an UNBORN CHILD, CHILD or PERSON as a human being, HB314<\/b><\/a>‘s<\/b> “exceptions” render the bill flawed insofar as identifying the bill as a Personhood Bill.\u00a0 HB314<\/b><\/a> is not<\/u> a Personhood Bill. While HB314<\/b><\/a> is better than “Heartbeat” bills, HB314<\/b><\/a> fails to learn from criticisms of the US Supreme Court on aspects of the Texas law overturned in Roe v Wade in Footnote #54 of the Roe Opinion:<\/p>\n

<\/a>[ Footnote 54<\/a> ] <\/a>When Texas urges that a fetus is entitled to Fourteenth Amendment protection as a person, it faces a dilemma. Neither in Texas nor in any other State are all abortions prohibited. Despite broad proscription, an exception always exists. The exception contained [410 U.S. 113, 158]\u00a0\u00a0 <\/span><\/a>in Art. 1196, for an abortion procured or attempted by medical advice for the purpose of saving the life of the mother, is typical. But if the fetus is a person who is not to be deprived of life without due process of law, and if the mother’s condition is the sole determinant, does not the Texas exception appear to be out of line with the Amendment’s command?<\/p>\n

There are other inconsistencies between Fourteenth Amendment status and the typical abortion statute. It has already been pointed out, n. 49, supra, that in Texas the woman is not a principal or an accomplice with respect to an abortion upon her. If the fetus is a person, why is the woman not a principal or an accomplice? Further, the penalty for criminal abortion specified by Art. 1195 is significantly less than the maximum penalty for murder
\nprescribed by Art. 1257 of the Texas Penal Code. If the fetus is a person, may the penalties be different?<\/p>\n
